FULL TERMS AND CONDITIONS for Digital Products

REQUIRED POSTING UNDER CALIFORNIA LAW: In compliance with California AB 2426, effective January 1, 2025, this Agreement clarifies that the purchase of digital artwork grants a license to use the artwork as specified herein and does not transfer ownership of the artwork. This provision applies to all sales and purchases made by California residents.


DIGITAL ARTWORK PURCHASE AGREEMENT - FULL TERMS AND CONDITIONS


Effective Date: January 1, 2025


This Digital Artwork Purchase Agreement (the "Agreement") governs the purchase and use of digital artwork from Chris Thompkins dba Christopher Thompkins Studios (the "Artist"). By purchasing and downloading the artwork, the buyer (the "Buyer") agrees to the following terms and conditions:


1. Grant of License


The Artist retains all rights, title, and interest in the Artwork, including all copyrights. Upon receipt of full payment, the Artist grants the Buyer a non-exclusive, non-transferable, revocable license to download and use the Artwork for personal, non-commercial purposes only. This license is granted for an indefinite period unless revoked under the terms of this Agreement.


2. Permitted Uses


The Buyer may:


Display the Artwork on personal devices (e.g., computer, smartphone, tablet).


Print the Artwork for personal use, not for resale or distribution.


If the Buyer shares the Artwork on social media or any public platform, they must credit the Artist as the original creator.


3. Prohibited Uses


The Buyer may not:


Use the Artwork for any commercial purposes, including but not limited to selling, licensing, or distributing the Artwork.


Modify, alter, edit, distort, recolor, animate, or create derivative works based on the Artwork.


Use the Artwork in AI training datasets, machine-learning models, or any automated content generation systems.


Mint, tokenize, or register the digital Artwork on any blockchain or NFT platform.


Resell, redistribute, gift, rent, sublicense, or transfer the digital Artwork to any third party.


Violation of this clause will result in immediate revocation of the license and may result in legal action.


4. Commercial Use License


If the Buyer wishes to use the Artwork for commercial purposes, a separate Commercial Use License must be obtained. Please contact the Artist to discuss terms and fees.


5. California AB 2426 Compliance


In accordance with California's AB 2426, effective January 1, 2025, this transaction grants the Buyer a license to use the digital Artwork as specified herein. This Agreement does not transfer ownership of the Artwork.


6. Termination


The Artist reserves the right to terminate this license immediately if the Buyer breaches any terms. Upon termination, the Buyer must cease all use of the Artwork and destroy any copies.


7. Governing Law & Dispute Resolution


This Agreement is governed by the laws of California. Any disputes shall be resolved through mediation or arbitration.


8. Refund Policy

All sales are final. No refunds, exchanges, or chargebacks will be accepted once the digital file has been downloaded.


9. Indemnification


The Buyer agrees to indemnify and hold harmless the Artist from any claims, damages, or legal disputes arising from misuse of the Artwork.


10. Agreement Updates


The Artist reserves the right to update this Agreement at any time. Future modifications apply to new sales.


11. Acceptance of Terms


By completing the purchase of the digital Artwork, the Buyer acknowledges and agrees to the terms of this Agreement. No signature is required; acceptance is confirmed through purchase.


12. Entire Agreement


This Agreement constitutes the entire understanding between the parties.

  • Device/Usage Data: Browser type, IP address, pages visited (via GoDaddy hosting).
  • Social Media: Interactions via Facebook/Instagram (subject to their policies).

2. How We Use Your Information

  • Provide art consulting and coaching services (scheduling via Calendly/Zoom).
  • Process payments (via Stripe/PayPal).
  • Email clients (via GoDaddy, Mailchimp/Delenta).
  • Improve marketing (Google Ads/tracking cookies).
  • Comply with legal obligations.

We do not sell your data.

3. How We Share Your Information

  • Service Providers:
    • Payment processors (Stripe/PayPal).
    • Scheduling tools (Calendly/Zoom).
    • Email platforms (GoDaddy/Mailchimp/Delenta).
  • Legal Compliance: If required by law.
  • Business Transfers: In case of merger/sale.

Third-Party Policies:

  • Stripe/PayPal handle recurring payments—we do not store full card details.
  • Google retains anonymized tracking data (we don’t control their policies).
  • Social media (Facebook/IG) data is subject to their privacy rules.

4. Data Security

  • Client intake forms are stored offline and kept confidential.
  • Payments are encrypted via Stripe/PayPal (PCI compliant).
  • Email marketing includes opt-out options (unsubscribe link in emails).

5. Your Rights

You may:

  • Access, correct, or delete your data.
  • Opt out of marketing emails (via unsubscribe link or by contacting us).
  • Request data portability (where applicable).
